Welcome to The Pixie & The Plate. By accessing our website (thepixieandtheplate.com), submitting an inquiry, or booking our luxury picnic and tablescaping services, you ("Client", "you") agree to the following Privacy Policy and Terms of Service.
PART I: PRIVACY POLICY
1. Information We Collect
We collect personal information that you voluntarily provide to us when submitting an inquiry, booking an event, or communicating with us. This includes:

Event Details: Preferred dates, rain dates, event locations, guest counts, and custom setup preferences.

Payment Information: Billing details (processed securely via third-party platforms; we do not store full credit card numbers on our servers).
2. How We Use Your Information
We use your information solely to:

Process bookings, issue invoices, and fulfill event styling services.

Communicate event logistics, permit requirements, and weather updates.

Process secure payments and retainer deposits.

Send administrative emails, order confirmations, or marketing communications (which you may opt out of at any time).
3. Data Protection & Sharing
We do not sell, rent, or trade your personal information to third parties. We only share data with trusted service providers necessary to operate our business (e.g., website hosting, scheduling platforms, and secure payment processors) or as required by law.
PART II: TERMS OF SERVICE & EVENT DISCLAIMERS
4. Booking, Payment Schedule & Retainers

50% Retainer: A 50% retainer and a signed service agreement are required at checkout to lock in your event date, time, and inventory. Dates will not be held without a paid retainer.

Final Balance: The remaining 50% balance, along with any applicable permit fees, travel surcharges, or custom add-ons, is due seven (7) calendar days prior to your scheduled event.

Accepted Payments: All payments must be completed electronically via major credit/debit cards, Apple Pay, or Zelle. Cash and checks are not accepted.
5. Cancellations, Refunds & Rescheduling

Cancellations 7+ Days Prior: Cancellations made seven (7) or more days before the scheduled event date are eligible for a 100% full refund of all monies paid (including the retainer), or a full credit applied toward a future booking within 180 days.

Cancellations Within 7 Days: Cancellations made within seven (7) days of the event forfeit the 50% retainer. Any additional balance paid may be credited toward a future date valid for up to six (6) months.

Cancellations Under 72 Hours: Cancellations made within 72 hours of the event or guest no-shows are strictly non-refundable and non-transferable due to committed labor and equipment scheduling.
6. Weather & Inclement Conditions Policy
We closely monitor local weather forecasts. If severe weather (e.g., rain, high winds, or extreme conditions) makes an outdoor setup unsafe or unfeasible:

We will notify you 24 to 48 hours prior to your reservation.

You may choose to:

Relocate: Move your picnic or tablescape to a covered or indoor venue provided by you.

Reschedule: Apply your full payment toward your designated Rain Date or any available date within 180 days.

Cancel: Receive a 100% full refund of your base booking fee.

Note on Perishables: Any third-party custom items (e.g., custom fresh florals or custom stationery) ordered specifically for your event cannot be refunded, but will be delivered to you on your original event date.
7. Code of Conduct & Safe Space Policy (Right to Refuse Service)
The Pixie & The Plate is a proudly women, LGBTQ+, and minority-owned business. We are dedicated to creating safe, inclusive, and welcoming environments for all our clients, guests, and team members.
We enforce a strict Zero-Tolerance Policy regarding any form of harassment, discrimination, or abusive behavior. This includes, but is not limited to, aggressive actions, hate speech, racism, sexism, homophobia, transphobia, xenophobia, or any discriminatory acts directed toward our staff, partners, or other park visitors.
If at any time during consultation, setup, event duration, or breakdown, the Client or any guest of the Client engages in hostile, unsafe, or discriminatory behavior, The Pixie & The Plate reserves the immediate right to decline service, terminate the event, or dismantle the setup without warning. In the event of contract termination due to violation of this policy, all fees paid are strictly non-refundable, and the Client assumes full responsibility for any resulting costs or equipment recovery.
8. Equipment Responsibility & Liability Waiver

Client Supervision: The Client assumes full responsibility for all equipment, rentals, furniture, decor, linens, and tableware from setup completion until breakdown. Equipment must never be left unattended.

Damage, Loss, or Excessive Soiling: Standard cleaning is included. However, the Client is financially responsible for any lost, stolen, or damaged items (including wine stains, candle wax damage, burns, or broken glassware). Replacement fees will be billed directly for repair or replacement at full retail value.

Limitation of Liability: Participation in outdoor/indoor events carries inherent risks. The Pixie & The Plate is not liable for personal injuries, illness, or third-party property damage sustained by the Client or guests during the event, except in cases of gross negligence by the Company.
9. Location Permits & Food/Beverage Disclaimers

Permits: While we set up at most public parks and beaches, any required park or commercial permit fees are the financial responsibility of the Client and will be added to your invoice.

Food & Alcohol: The Pixie & The Plate does not provide food or alcoholic beverages. Clients are responsible for supplying their own food and drinks, as well as adhering to all municipal park rules regarding public alcohol consumption.
10. Photography & Visual Content Rights
The Pixie & The Plate reserves the right to take photographs and video footage of our setups, decor, and table styling for promotional, website, and social media purposes. We will always respect your privacy and will never publish photos featuring recognizable client faces without explicit verbal or written permission. If you prefer that your event setup not be photographed, please inform us in writing prior to your event date.
11. Intellectual Property
All content on thepixieandtheplate.com—including business branding, custom text, design assets, website layout, and images—is the exclusive intellectual property of The Pixie & The Plate. Unauthorized reproduction, duplication, or copying of any material without express written consent is strictly prohibited.
